TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, or using UpMode ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

UpMode is a discipline-based alarm application developed by Sefe Labs that requires users to complete a physical or cognitive mission before an alarm can be dismissed. The App includes missions such as push-ups, mathematics, step counting, and photo tasks.

3. Eligibility

You must be at least 13 years old to use UpMode. If you are between 13 and 17, you confirm that you have obtained parental or guardian consent. By using the App you represent that you meet these requirements.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating an account.
• You must notify us immediately of any unauthorised use of your account.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or modify the App.
• Attempt to bypass or manipulate alarm missions.
• Interfere with the App's functionality or security.
• Use the App in any way that could damage, disable, or impair the service.

6. Missions and Physical Activity

UpMode includes missions that require physical activity such as push-ups and step counting. By using these missions you acknowledge that:

• You are physically capable of performing the required activities.
• You accept full responsibility for any injury that may result from physical missions.
• UpMode is not a fitness application and does not provide medical advice.
• You should consult a medical professional before beginning any new exercise routine.

7. Alarm Functionality

UpMode is designed to prevent alarm dismissal without mission completion. While we make every effort to ensure reliable alarm delivery:

• Alarm functionality depends on device settings, battery optimisation settings, and Android system behaviour.
• We cannot guarantee alarm delivery in all circumstances.
• You are responsible for ensuring your device settings allow the App to function correctly.
• Do not rely solely on UpMode for time-critical situations.

8. Subscriptions and Payments

UpMode Pro is available as a monthly subscription at $4.99/month and a yearly subscription at $39.99/year. Both plans include a 7-day free trial for new subscribers.

Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You will be charged through your Google Play account. To cancel, go to Google Play Store → Subscriptions → UpMode and cancel from there.

Free trial eligibility is determined by Google Play and is available to new subscribers only. If you do not cancel before the trial period ends, you will be charged the subscription price.

9. Intellectual Property

All content, design, code, and functionality within UpMode are the property of Sefe Labs and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the App without written permission.

10. Disclaimer of Warranties

UpMode is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Sefe Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to missed alarms, missed appointments, or injury from physical missions.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time through the App or by contacting us.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria. This will be updated to reflect the governing jurisdiction of Sefe Labs' place of incorporation once formally registered.

14. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.
